Terms of Use

These Terms of Use ("Terms") are an agreement between you and Nomadix Apps LLC ("we", "us", "our") governing your use of the TrayHabit mobile application ("the App"). By downloading, installing, or using the App you agree to these Terms. If you do not agree, do not use the App.

The App is distributed through the Apple App Store and is licensed, not sold, to you. Apple's Licensed Application End User License Agreement (the "Standard EULA") applies to your use of the App; these Terms supplement the Standard EULA, and in case of conflict regarding the license, the Standard EULA prevails. Apple is not a party to these Terms and is not responsible for the App or its content, but Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

⚕️ Not a medical device. TrayHabit is a self-tracking tool for personal, informational use. It does not provide medical advice, diagnosis, or treatment, and it is not a substitute for professional dental or orthodontic care. Default targets (such as the 22-hour daily goal), reminders, statistics, streaks, and achievements are informational conveniences only. Always follow the treatment plan and instructions of your orthodontist or dentist, and consult them before making any decision about your treatment.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction to use the App without parental consent) to use the App. If you are a minor, you may use the App only with the involvement and consent of a parent or guardian.

2. License

Subject to these Terms and the Standard EULA, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, for your personal, non-commercial use.

3. Subscriptions and purchases

The core features of the App are free. The App offers an optional auto-renewable subscription, TrayHabit Pro, which unlocks additional features. Subscription options, periods, and prices are shown in the App before purchase.

Billing. Payment is charged to your Apple ID account at confirmation of purchase. All billing is handled by Apple; we never receive your payment details.
Auto-renewal. Subscriptions renew automatically for the same period unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends, at the price shown when you subscribed (or as subsequently adjusted with notice through the App Store).
Managing and cancelling. You can manage or cancel your subscription at any time in your device settings: Settings → your Apple ID → Subscriptions. Cancelling stops future renewals; you keep access to Pro features until the end of the period already paid for. Uninstalling the App does not cancel a subscription.
Free trials and offers. If a free trial or introductory offer is available, its length and terms are shown before purchase. Any unused portion of a free trial is forfeited when you purchase a subscription. Trials convert into paid subscriptions unless cancelled at least 24 hours before the trial ends.
Refunds. Purchases are processed by Apple, and refunds are governed by Apple's policies. You can request a refund at reportaproblem.apple.com. We cannot issue refunds directly.
Restoring purchases. Use "Restore Purchases" in the App while signed in with the Apple ID used for the original purchase.
Price changes. If subscription prices change, Apple will notify you in accordance with its policies, and where required, ask for your consent before charging the new price.

4. Your data and backups

Your tracking data is stored locally on your device (see the Privacy Policy). You are responsible for maintaining device backups. Deleting the App deletes its local data; we have no copy and cannot restore it. We are not liable for loss of data resulting from device loss, deletion of the App, iOS updates, or failures of device backups.

5. Acceptable use

You agree not to:

copy, modify, distribute, sell, lease, or sublicense the App or any part of it;
reverse-engineer, decompile, or attempt to extract the source code of the App, except to the extent permitted by applicable law;
use the App in violation of applicable laws or Apple's App Store terms;
circumvent, disable, or interfere with subscription entitlements or other technical limitations of the App.

6. Intellectual property

The App, including its design, graphics, icons, text, and software, is owned by Nomadix Apps LLC or its licensors and is protected by copyright and other intellectual-property laws. These Terms grant you no rights other than the limited license in Section 2. "TrayHabit" and the TrayHabit icon may not be used without our prior written permission. Third-party trademarks (including aligner brand names, if referenced) belong to their respective owners; TrayHabit is an independent app and is not affiliated with, endorsed by, or sponsored by any aligner manufacturer or dental provider.

7. Third-party services

The App relies on services provided by Apple (App Store, payments, notifications) and RevenueCat (subscription management, as described in the Privacy Policy). We are not responsible for the availability or performance of third-party services, and their terms govern your relationship with them.

8. Changes to the App

We may add, change, or remove features of the App (including features labelled "coming soon"), and may update these Terms to reflect such changes. We may discontinue the App or its distribution at any time; if the App is discontinued, active subscriptions will remain manageable through Apple, and you may request a refund from Apple for any unused period in accordance with its policies.

9. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT RECORDED DATA WILL NEVER BE LOST OR INACCURATE. TIMERS, REMINDERS, AND NOTIFICATIONS DEPEND ON YOUR DEVICE AND iOS SETTINGS AND MAY NOT ALWAYS FIRE OR MAY BE DELAYED.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. Nothing in these Terms affects statutory consumer rights that cannot be waived.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NOMADIX APPS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE APP — INCLUDING, WITHOUT LIMITATION, ANY OUTCOME OF YOUR ORTHODONTIC OR DENTAL TREATMENT. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP AND SUBSCRIPTIONS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY US DOLLARS (US $50), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless Nomadix Apps LLC from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the App, to the extent permitted by applicable law.

12. Termination

These Terms are effective until terminated. Your rights under these Terms terminate automatically if you fail to comply with them. Upon termination, you must stop using the App and delete it. Sections 4, 6, and 9–14 survive termination.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which Nomadix Apps LLC is organized, without regard to its conflict-of-law rules, except where the mandatory consumer-protection laws of your country of residence provide otherwise. Disputes shall be resolved in the courts of that jurisdiction, unless applicable law grants you the right to bring proceedings in your country of residence.

14. Miscellaneous

If any provision of these Terms is held invalid, the remaining provisions remain in full force. Our failure to enforce any right is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Standard EULA and the Privacy Policy, constitute the entire agreement between you and us regarding the App.

15. Changes to these Terms

We may update these Terms from time to time. The current version is always available at this page, with the effective date shown above; previous versions are available in the site's public history. For material changes, we will provide notice in the App or on this site before the changes take effect. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
